Terms & Conditions

1. General provisions

These Terms & Conditions apply to the sale, service and rental of bicycles and bicycle accessories by Muck'n'Ride KG (hereinafter: "the provider"). A separate rental agreement applies to all rental transactions, concluded individually with each renter.

These Terms apply to all current and future transactions. Any deviating conditions are only valid in writing and with the provider's consent.

2. Products and services

• Sale of bicycles and bicycle accessories
• Maintenance and service of bicycles and accessories
• Rental of bicycles and accessories (governed by a separate rental agreement)

3. Conclusion of contract

• For sales and service, the contract is concluded upon delivery of the goods or provision of the service.
• For rentals, the terms of the separate rental agreement apply.

4. Prices and payment

• All prices include VAT unless otherwise stated.
• Payment can be made in cash, by bank transfer or by individual arrangement.
• Advance payments or deposits for rentals are handled according to the rental agreement.

5. Delivery, handover, risk

• Sold products pass to the buyer upon handover.
• For rentals, the renter bears responsibility and risk from the moment of handover.
• During servicing, the products remain temporarily under the provider's supervision; damage caused by intended use is the customer's responsibility, except in cases of intent or gross negligence by the provider.

6. Use and liability

• Products must be used only for their intended purpose.
• The renter is obliged to use bicycles in accordance with the rental agreement.
• Damage, theft or loss is at the expense of the buyer/renter.
• For service work, use must follow the provider's instructions; accidents are the customer's responsibility.

7. Defects, complaints

• Defects in purchased products must be reported without delay.
• Defects arising during service work must be reported immediately.
• For rental objects, the rules of the rental agreement apply.

8. Data protection

• Personal data is processed in accordance with the GDPR.
• Purpose of data processing: handling of sales, service and rentals as well as marketing.
• Customers agree to be informed by email about offers and promotions; this consent can be withdrawn at any time.

9. Warranty and guarantee

• Statutory warranty provisions apply to sold products.
• For service work, the warranty conditions defined in the agreement apply.
• For rentals, the warranty and liability conditions of the rental agreement apply.

10. Legal provisions and jurisdiction

• These Terms and all contracts are governed exclusively by Austrian law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
• The competent court at the provider's place of business has jurisdiction over disputes.
• Mandatory consumer protection provisions of the Austrian KSchG remain unaffected.
